Payments on the basis of Life Certificate Defence Pensioners

OFFICE OF THE PR. CONTROLLER OF DEFENCE ACCOUNTS (PENSION)
DRAUPADI GHAT, ALLAHABAD- 211014
Important Circular No.176
Dated: 17.11.2014
Subject: Payments on the basis of Life Certificate
Provisions regarding payment of pension to defence pensioner/family pensioners on the basis of Life Certificates are provided in Defence Pension Payment Instructions 2013.
2. As per the extant procedure, pensioner who does not appear in person for one or other reasons can produce a Life Certificate as in Form No. 5 of Appendix 11 to DPPI 2013 from one of the authorities mentioned at items I to XIX of para 69 of ibid Instructions during the month of November every year. Similar provisions are available in Scheme for payment of pensions of Defence Pensioners by Public Sector Banks. This causes hardship particularly to those who are aged and/or infirm Pensioners. Besides, the existing system is prone to misuse by way of fraudulent withdrawls causing loss to the exchequer.
3. To overcome above causes /situation, the Department of Electronics & IT, Ministry of Communications & IT, Government of India has developed “Jeevan Pramaan Digital Life Certificate” Portal (jeevanpramaan.gov.in).
4. In view of the above, it has been decided that with immediate effect a Life Certificate issued online by a Government Agency as a result of Aadhaar Biometric Authentication will also be accepted as a valid certificate. This document may be accessed through a website ( to be notified separately) by the Pension Disbursing Agency without insisting either on personal appearance of the pensioner or Life Certificate by the competent authority referred above.

No Full Pension for the Pre 01 Sep 2008 retirees?

With the issue of the Office memorandum dated 12.05.09, Government ruled out full pension for those who retired after 1.1.2006 but before 2.9.2008, even if they had completed 20 years of service. As per this latest clarification (OM dated 12.05.09), Government servants who retired before 2.9.08 with qualifying service of 33 years will continue to be proportionate to the full pension based on their actual qualifying service.
As per the said clarification OM dated 12.05.09, the basis for taking this decision is the Government took a policy decision to implement the the provision for full pension after 20 years of service with effect from 2.9.08.
It was also clarified by the Government that in light of various decisions of Apex Court allowing the employer to fix a cut-off date for introducing any new pension/retirement scheme, the decision of Government is in accordance with the law and there is no violation of Article 14 of the Constitution. "One Rank One Pension", I'm sure you want to know what this is?

"One Rank One Pension" ( OROP ) is an emotive issue. When two soldiers of the
same rank and with equal length of service find that they are in receipt of
different pensions, just because they retired on different dates, they are unable
to reconcile with the situation. The feeling of hurt is not confined to lower
ranks alone. Even general officers whose pension was depressed by the Fifth Pay
Commission, felt so aggrieved that they took the matter to the court to seek
justice, and their case is still pending in the Supreme Court. OROP is one of
the few pending grievances of our veterans.

Clarification issued by CGDA related to pensions

The CGDA has further clarified that the said Annexure-III is not the ultimate
determinator for the entitlement of pension and in case the revised pension as
per Annexure –I to the MOD’s letter dated 11.11.2008 happens to be more
beneficial than the one indicted in the Annexure -III ibid, more beneficial
pension will be payable. However, in case the pension consolidated as per
Annexure –I read with para 4 of MOD letter dated 11.11.2008 is less than the
amount indicated in Annexure –III, the pension protection as indicated in these
tables will be given. The rate of pension in Annexure –III is protective and not
the entitlement. Kindly go through the circular for a lot of additional information

Family Pension for the Missing Armed Forces Personnel

Reproduction of Government of India, Ministry of Defence,Letter No. 12(16)/86/D(Pension Service) Dated 3rd June, 1988 http://www.mediafire.com/?myeiy1jrwg3
Sub.:- Release of DCRG, leave Encashment and family Pension in respect of Armed Forces personnel who are missing.
Sir
A number of cases have been referred to this Ministry for grant of terminal and other pensionary benefits to the families of service personnel who have suddenly disappeared while in operational and non-operational service and whose whereabouts are not known. At present all such cases are considered on merits. In the normal course unless a period of 7 years has elapsed from the date of disappearance of the employee, he cannot be deemed to be dead and therefore the retirement benefits cannot be paid to the family. This principle is based on Section 108 of the Indian Evidence Act which provides that when the question is whether the man is alive or dead and it is proved that he had not been heard of for 7 years by those who would naturally have heard of him had he been alive, the burden of proving that he is alive is shifted to the person who affirms it. This has resulted in grant hardship and distress to the families who have to wait for 7 years before any terminal benefits could be paid to them.
2. The president is therefore pleased to decide that when a member of the ‘Indian Armed’ Forces is declared missing while in service, the family will be paid the following benefits subject to adjustment of outstanding dues in respect of the missing personnel, if any:-

(a) Immediately after the date of declaration of disappearance:
The amount of salary due, leave encashment due and DSOF/AFPP Fund amount subject to nomination made by the missing personnel.
(b) After the lapse of one year from the date of declaration of disappearance/ presumption of death:
Family pension/ DCRG etc. as admissible in normal conditions.
3. The above benefits may be sanctioned after observing following formalities :-
(i) The family must lodge a report with the concerned Police Station and obtain a report that the employee has not been traced after all efforts had been made by the police.
(ii) The claimant will be required to furnish an indemnity bond with two solvent sureties to the effect that all payments thus made will be recovered from the amount due to the person if he/ she reappears and makes any claims.
4. The family can apply to the concerned authority for grant of family pension and DCR Gratuity after one year from the date of declaration of disappearance of the service personnel in accordance with the procedure for sanction of family pension and DCR Gratuity. In case the disbursement of DCR Gratuity is not effected within 3 months of the date of application, the interest shall be paid at the rates applicable and responsibility for the delay fixed.
5. In the case of officers, the respective Branch/ Dte at Service HQrs and in the case of JCOs/ OR and equivalent in Navy and Air Force, their respective Records Offices will process such cases with CDA(O)/PAO/CDA(P)/CDA(Navy)/CDA(Air Force).
6. The provisions of this letter take effect from 29th August, 1986.
7. This issues with the concurrence of the Finance Division of this Ministry vide their u.o. No. 802- Pen of 1988.

Yours, faithfully,
Sd/-(Y.K. TALWAR)Desk Officer
